These Terms of Service (“Terms”) apply to your access to and use of our website, Shopify storefront, physical retail location, and any related services, purchases, pickups, trades, or communications with Berks Vintage & Streetwear (“Berks,” “we,” “us,” or “our”).

By visiting our site, purchasing from us online or in-store, scheduling pickup, or participating in any buy, sell, or trade transaction, you agree to these Terms.

2. ONLINE + IN-STORE OPERATIONS

Berks operates as both an online store and a physical retail store. Inventory may be offered for sale at the same time through both channels.

We work to maintain accurate stock levels, but availability is not guaranteed until your order is completed and accepted. If an item becomes unavailable due to an inventory sync issue, oversell, listing error, or pricing mistake, we reserve the right to cancel the order and issue a full refund.

3. PRODUCT NATURE + CONDITION

Berks offers a curated mix of vintage, pre-owned, second-hand, deadstock, streetwear, footwear, accessories, and selected new merchandise.

Because many pieces are vintage or previously worn, items may show signs of age, wash, fading, distressing, repairs, alterations, storage wear, or other minor imperfections consistent with their character and history. These qualities are part of the nature of the product and are not automatically considered defects.

Customers are responsible for reviewing all photos, sizing, measurements, descriptions, and condition notes before purchase.

4. PRICING + PAYMENT

We reserve the right to correct errors in pricing, product information, or listings at any time, including after an order has been placed. If payment has already been made for an order we cannot fulfill, a refund will be issued to the original payment method.

5. FINAL SALE POLICY

All sales are final.

Due to the nature of our inventory, including one-of-one, vintage, pre-owned, and limited pieces, Berks does not offer returns, refunds, or exchanges for sizing issues, buyer’s remorse, change of mind, normal vintage wear, or minor variations in color, texture, fading, or fit.

6. SHIPPING + DELIVERY

We offer shipping to available domestic and international destinations.

Shipping timelines are estimates only and are not guaranteed. Delivery may be affected by carrier delays, customs processing, weather, holidays, or other events outside our control.

Customers are responsible for entering a complete and accurate shipping address. Berks is not responsible for delays, losses, or delivery issues caused by incorrect address information, carrier issues, customs holds, or package theft after confirmed delivery.

Any customs duties, import taxes, VAT, brokerage fees, or related charges are the responsibility of the customer unless otherwise stated.

7. PICKUP ORDERS

Where pickup is available, customers will be notified when the order is ready. Valid identification and proof of purchase may be required at pickup.

10. IN-STORE CONDUCT

Customers visiting our physical location are expected to treat staff, customers, merchandise, and property with respect.

We reserve the right to refuse service or require any person to leave the premises for disruptive, threatening, abusive, unlawful, or unsafe conduct.

Berks is not responsible for personal property lost, stolen, or damaged on the premises except as required by law.

11. INTELLECTUAL PROPERTY + BRAND REFERENCES

All original content on our website, including our branding, text, design, graphics, layout, photography, and creative materials, is owned by or licensed to Berks Vintage & Streetwear and may not be copied, reproduced, or used without prior written permission.

All third-party brand names, logos, and trademarks appearing on products remain the property of their respective owners and are used only to identify the goods offered for sale. Berks is an independent retailer and is not affiliated with or endorsed by any third-party brand unless expressly stated.

You agree not to misuse our website or services, including by attempting unauthorized access, interfering with site functionality, copying content without permission, transmitting harmful code, or using the site for unlawful purposes.
